The case is of major importance as the Court accepted, among others, that outside sales employees are not entitled to overtime payment if the employer is in no position to control the employee’s working schedule and thus no overtime work is proven.

The Athens Court of First Instance had not only accepted the claims of the client, but also reversed the existing jurisprudence in relation to the protection of Public entities under Presidential Decree 715/1979. The Athens Court of Appeals also rejected this protection and acknowledged the predominance of the provisions for commercial leases (PD 34/1995). The case can be considered as landmark.
